Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs use of the Vanday service and Site (collectively, the "Service") and is incorporated into the Terms of Service. "You" means the customer and its Authorized Users. We may update this AUP prospectively.

1Prohibited content

You may not upload, store, or share content through the Service that:

• infringes or misappropriates any intellectual property, privacy, or publicity rights;
• is unlawful, defamatory, harassing, threatening, or hateful;
• sexually exploits minors (CSAM) — strictly prohibited and reported to authorities as required by law;
• contains malware, ransomware, or other malicious code;
• contains another party's personal or sensitive data without a lawful basis and required permissions; or
• violates any applicable law or regulation.

2Prohibited conduct

You may not:

• attempt to gain unauthorized access to the Service, other accounts, or our systems;
• probe, scan, or test the vulnerability of the Service except under a program we have authorized in writing;
• interfere with or disrupt the integrity or performance of the Service (e.g., denial-of-service attacks);
• circumvent usage limits, seat limits, authentication, or security measures;
• reverse engineer, decompile, or copy the Service except as permitted by applicable law;
• resell, sublicense, or provide the Service to third parties except as expressly permitted;
• use the Service to build a competing product or to benchmark without our written consent;
• scrape or use automated means to extract data beyond what is permitted by the Service's documented endpoints; or
• use the Service to send spam or unlawful communications.

3Fair use of resources

Your usage must stay within the limits of your plan (assets, storage, seats, workspaces), including during your free trial; plan limits stated in the Service apply. Excessive or abusive consumption that degrades the Service for others may result in throttling, plan limits being enforced more strictly, or suspension.

4AI features

You may not use AI-tagging or other AI features in the Service to generate unlawful content, to attempt to extract another party's data, or in violation of the AI provider's usage policies (currently OpenAI's, available at openai.com/policies/usage-policies).

5Enforcement

We may investigate suspected violations and may remove content, throttle, suspend, or terminate access (with notice where practicable) as described in the Terms of Service. We may preserve and disclose information where required by law or to protect rights and safety.

6Reporting

Report violations, abuse, or security concerns to crew@vanday.ai.

To report copyright infringement under the Digital Millennium Copyright Act (DMCA), send a written notice to crew@vanday.ai including: (a) a description of the copyrighted work, (b) a description of the infringing material with a URL or other location, (c) your contact information, (d) a statement that you believe in good faith that the use is not authorized, (e) a statement under penalty of perjury that the information is accurate and that you are authorized to act on behalf of the rights holder, and (f) your physical or electronic signature.
